Broward County, FL Preempted from Adopting Retail Establishment Parking Security Camera Ordinance
Broward County proposed an ordinance that would require retail businesses to install security surveillance cameras that would cover the entire parking lot 24/7, and require retention of images for at least 30 days. The ordinance would add sections to chapter 21 of the Broward County Code of ordinances creating the Retail Establishment Parking Security Ordinance; providing findings; defining "Retail Establishment" and "Retail Establishment Parking Area"; providing for applicability throughout Broward County; requiring certain retail establishment parking areas to be equipped with specific security devices; providing for compliance dates; providing for licenses; providing for enforcement; amending subsection 8 1/2-16(f) of the Broward County Code of ordinances to provide civil Penalities. At the public hearing on August 12, individuals and organizations, as well as the majority of Commissioners, agreed that the ordinance has the potential to be very expensive and burdensome for private businesses, as well as increasing the liability of business operators and property owners. As a result, the Commission agreed to form a task force to further review this issue and is calling on all those who want to give input on the issue to contact them. The Task Force has its first meeting on Tuesday, September 2 at 6:30 pm at the Broward County Government Center. Issue History
06/02/09 On 6/1/09, Governor Crist signed SB 360 preempting Local Governments from adopting parking security camera ordinances, in addition to other Growth Management provisions.
01/26/09 The Commission has not yet set a date for future discussion. No further action at this time.
11/14/08 The ordinance was withdrawn from the 11/13/08 Commission Meeting Agenda. According to the South Florida Sun-Sentinel Article (attached below), "Commissioner Josephus Eggelletion, the primary sponsor of the proposal, said a lack of cooperation from businesses hampered his work to draw up specifics. But he plans to have them ready by January [2009]. On Thursday, he said the proposal he will offer in January would not require 24-hour surveillance, would phase in installation over three years and would set different standards on the extent of camera coverage based on other security measures."
11/07/08 The Commission withdrew the ordinance from the 11/13/08 Commission meeting agenda. The ordinance will be resubmitted in 1/09.
11/06/08 The Commission plans to withdraw the ordinance from the 11/13/08 meeting agenda, and consider resubmission in 1/09.
11/03/08 The Commission will continue discussion of the ordinance at the 11/13/08 Commission Meeting at 2:00 pm.
10/28/08 The task force meeting scheduled for 10/29 has been cancelled. The rescheduled date and time is to be determined.
10/27/08 A fourth task force meeting is scheduled for 10/29/08, at 10 a.m., in Room 430 at the Broward County Government Center at 115 South Andrews Avenue, Fort Lauderdale.
10/17/08 The task force met on 10/15/08 and decided to continue discussions in committees. The details are laid out in the minutes from the meeting.
10/03/08 A third task force meeting is scheduled for 10/15/08, at 10:00a.m., in Room 430 at the Broward County Government Center at 115 South Andrews Avenue, Fort Lauderdale. Pending issues upon previous comments and suggestions will be discussed. The drafted ordinance with minor revisions is attached below.
09/19/08 A second task force meeting was held on 9/17/08, the Commission plans to amend the ordinance. A public hearing is scheduled for the Regular County Commission Meeting on 11/13/08. No additional task force meetings are scheduled at this time.
09/08/08 The Commission will hold the second task force meeting on 9/17/08 at 1:00 p.m., in Room 430 of the Broward County Governmental Center at 115 South Andrews Avenue, Fort Lauderdale.
09/04/08 At the 9/2/08 meeting, the Commission discussed scheduling a second Task Force Meeting, date to be determined.
08/28/08 The Commission will hold the first task meeting on Tuesday, September 2 at 6:30 pm at the Broward County Government Center.
08/12/08 The County Commission adopted a motion that will create a task force to receive public input to revise the body of the ordinance. It will be brought back for a public hearing at the November 13, 2008 meeting at 2:00.
08/08/08 The County Commission will hold a public hearing at the 8/12/08 meeting.
06/22/08 The County Commission will schedule a public hearing at the 6/24/08 meeting for 8/12/08. The County Commission will consider an ordinance relating to retail establishments; adding sections to Chapter 21 of the Broward County Code of Ordinances creating the retail establishment parking security ordinance; providing findings; defining "Retail Establishment" and "Retail Establishment Parking Area"; providing for applicability throughout Broward County; requiring certain retail establishment parking areas to be equipped with specific security devices; providing for compliance dates; providing for licenses; providing for enforcement; amending subsection 8½-16(f) of the Broward County Code of Ordinances to provide civil penalties.
